Adrian and Jamie Ledesma

ledesmabrothers_11714Adrian Ledesma (age 23) and his brother Jamie (age 24) were arraigned today on three counts apiece of CSC with a 14-year-old victim.

Adrian was a boys basketball coach in the Bloomingdale public school system when he began corresponding with his victim.  the criminal incidents took place between December 2012 and June of 2013.

Adrian is facing two charges of 1st degree CSC and one count of 2nd degree CSC, while his brother is charged with one count each of 1st, 3rd, and 4th degree CSC.  Below is a breakdown of what these charges mean.

Act 328 of 1931

Chapter LXXVI: RAPE

1st degree (MCL 750.520b): felony including conditions of the victim being either under 13 or between 13-15, the perpetrator being in a position of authority over or in the same household as the victim, or the perpetrator being a school employee or a blood relative of the victim.  Sentencing standard: 25 years to life.

2nd degree (MCL 750.520c):  felony including conditions of the victim being either under 13 or between 13-15, the perpetrator being in a position of authority over or in the same household as the victim, or the perpetrator being a school employee or a blood relative of the victim, aided and abetted by at least one accomplice.  Sentencing standard: imprisonment up to 15 years.

3rd degree (MCL 750.520d): felony including conditions of the victim being between the ages of 13-15, the perpetrator being in a position of authority over the victim, or the perpetrator being a school employee or a blood relative of the victim, and force or coercion is used to commit the act.  Sentencing standard: imprisonment up to 15 years.

4th degree (MCL 750.520e): misdemeanor including conditions of the victim being between 13 and 18 (16-18 if a student where the perpetrator is employed), force or coercion is involved, or the victim is a patient in the medical care of the perpetrator.  Sentencing standard: imprisonment up to 2 years and/or fines up to $500.
